Rideshare accident deadlines: why waiting can create problems

After an accident, it is easy to assume that an open claim means there is plenty of time. But different parts of a matter can follow different timelines. A conversation with a platform or insurer does not, by itself, tell you when a lawsuit would need to be filed.

Do not use one deadline for every question

Florida’s current limitations statute generally provides two years for negligence actions. The applicable rule still depends on the claim, when it arose, and any relevant exceptions or special requirements. An older accident or a different type of claim may need a different analysis.

That general period is not a personalized filing date. An attorney should review the accident date, parties, and circumstances before you rely on a calendar calculation.

Track correspondence and requests separately

Keep every dated letter, email, and request for information. Policy reporting and cooperation provisions can create questions separate from the lawsuit deadline. If you are uncertain about a request, seek clarification promptly and preserve the document rather than ignoring it.

Do not assume that negotiation, a claim number, or an unanswered message automatically extends time. Ask specifically what deadlines apply and whether any action is needed while discussions continue.

Evidence has its own practical timeline

You may want to save trip information, identify witnesses, or ask about possible video before a legal deadline is close. That is a practical preservation issue, not a reason to guess how long a particular source keeps its records.

Make a list of potentially relevant material and who might hold it. Share that list with your attorney. A missing record is easier to investigate when its likely source and approximate date are clear.

Make your first appointment useful

Bring the accident date, any known trip or claim numbers, and a chronological collection of correspondence. Tell the attorney about documents already signed and any upcoming dates mentioned in a letter.

If you are worried time has already passed, do not decide on your own that the matter is too late. Get advice based on the actual facts. An early conversation can also identify what can be handled now and what information still needs to be gathered.
